Privacy Policy for website and mobile application

Memphis Wood Fire Grills, LLC (“Memphis Grills”) values your privacy. This Privacy Policy describes how we collect and handle information that we receive through our website at https://memphisgrills.com (“Site”) and all related and subsidiary webpages, through access to any optimized version of our Site via a wireless device and through our mobile application (“App”).   Terms such as “we,” “our” and “us” refer to Memphis Grill. Our Site and App are together referred to as the “Services.”

By accessing and using the Site, or by downloading or using the App, you consent to the collection, use, and storage of your information by us in the manner described in this Privacy Policy. We reserve the right to change and update this Privacy Policy and such updated versions will be posted on the Site and made available through a link in the App. By continuing to use the Services after this Privacy Policy is updated, you consent to any such updated version of this Privacy Policy. In addition to this Privacy Policy, your use of our Services is governed by our Terms of Use.

How We Collect and Use Information

Personally Identifiable Information

We may collect personally identifiable information (“PII”) such as your name and contact information if you choose to provide it to us. For example, you may submit your PII to us if you sign up to receive emails from us, or by submitting a Contact form and providing your name and email address, and/or by submitting a Warranty Registration Form for a product you have purchased. Memphis Grill maintains and uses the PII you provide in order to fulfill your requests and respond to inquiries and comments, manage our warranty program, to analyze and improve our products and services, send messages about new app updates or offerings, and to conduct marketing.

Memphis Grills will not sell or rent any PII collected on this Services to third parties for their direct marketing or other purposes.

We may disclose your PII to third party vendors engaged by Memphis Grill to help manage our Services, provide advertising and marketing services, provide services, or fulfill your product orders, process payments or fulfill other requests. For example, if you are purchasing any products, our third party payment processors will receive credit card information as may be further described in any terms of sale and any referenced policies of such third party processors. In general, we require our third party service providers and vendors to restrict their use of such PII received through our Services to the intended purposes. Notwithstanding anything the foregoing, Memphis Grill may disclose PII to comply with any legal obligation, to enforce or apply our Terms of Use or to protect our rights or those of other parties. In addition, we may need to, and we reserve the right to, disclose or transfer any PII to third parties in connection with selling or liquidating any part of our business or assets.

Location Information

We may collect and use approximated or real time location information, such as GPS location, from devices you use to access the Services. We will provide you with notice and an opportunity to consent before we access and collect your real time location information, and depending on your device manufacturer, you may have the ability to revoke this consent at any time.

Technical Information

The Services collects certain non-personal technical information that you do not visibly enter, such as your IP address, browser type, click stream data, usage information and statistics, HTTP protocol elements, and the status of cookies placed on your computer or personal device by Memphis Grill. If you access the Service from a mobile phone, tablet, automobile, or other electronic device, we may collect and store information such as device type, operating system version and type, unique identifiers (such as Android Advertising ID, VIN, MAC address, and IDFA), carrier, and other related information for that device. In addition, in order to manage and improve our Services, we or our service providers may use cookies (small packets of information that are stored by your web browser) or web beacons (electronic images that allow us to count visitors who have accessed a webpage). These tools do not identify you personally and allow us to track and analyze aggregated usage data about our Services and its use.   Our Services may also use third party analytics vendors [such as Google Analytics. We and our third party vendors or partners use analytics data for a variety of purposes such as to improve the design and content of our Services and understand what users like to see.

While using our Services, You may choose to block or disable cookies from your device using your browser settings or options. However, this may impact your user experience and parts of the Services may not work for you. You cannot remove or block web beacons as they form part of the content of the web pages, however because they work in conjunction with cookies, turning off cookies will prevent web beacons from tracking your user activity on our Services. The beacon can still account for an anonymous visit, but your unique information will not be recorded.

All non-personal information collected through this Services may be used and shared by us without any restriction.

Do Not Track Disclosure

This Services does not monitor for or behave differently if your computer transmits a “do not track” or similar beacon or message.

Your Choices: Updating Your Information

If you do not want us to collect PII from you, you should not submit such information to us. If you opt-in to receive updates and information from us by completing a form or submitting a request, we may send you e-mails about a variety of topics, products, promotional offers and company information. Security

Memphis Grill has implemented generally accepted standards of technology and operational security in order to protect personally-identifiable information from loss and misuse. Despite these precautions, Memphis Grill, however, cannot guarantee that unauthorized persons will not obtain access to your personally-identifiable information.

Transborder hosting and transfer of information

Personally-identifiable information collected on the Services may be transferred from time to time to Memphis Grill offices or personnel, or to third parties, located throughout the world, and the Services may be viewed and hosted by Memphis Grill or its vendors anywhere in the world, including countries that may not have the same data protection laws as those in your country of residence. By using the Services and registering such information on it, you voluntarily consent to such transborder transfer and hosting of such information.

California Civil code § 1798.83 provides certain rights to California residents, including the right to request information from a business, with whom the California resident has an established business relationship, regarding the business’s disclosure of personal information to third parties for marketing purposes by such third parties during the immediately preceding year.
